Please read the Terms & Conditions (the “Agreement”) carefully before using therapeasy.co, operated by HealthUp LLC. This agreement sets forth the legally binding terms and conditions for your use of the site therapeasy.co. By accessing or using this site in any manner, you are entering this Agreement, and agree to be bound by these Terms and Conditions.
Terms “we”, “us”, “our” or similar are used in this Agreement to refer to any company or persons that own and operate the Site (the “Company”).
Acceptable Use. This Site is intended to provide users with general information. Therapeasy does not endorse any specific professionals, tests, products, procedures, opinions, treatment, or other information that may be mentioned on the Site. Use of any information provided by Therapeasy, our employees, or others on the site is solely at your own risk.
- Incorporated Terms. The following additional terms are incorporated into this Agreement as if fully set forth herein:
- Privacy Policy
The Providers. The Site may be used to connect you with or introduce you to a Provider who will provide services to you outside of the Site. The role of the Site is the intermediary to connect users with Providers. Therapeasy, the Site, and employees do not provide any care or treatment. We are not involved with or responsible for the patient-provider relationship (user-user relationships), medical malpractice, medical negligence or communication.
We require every Provider listed to be an accredited, trained, and experienced licensed psychologist (PhD/ PsyD), licensed marriage and family therapist (LMFT), licensed clinical social worker (LCSW), licensed professional counselor (LPC), psychiatrist (DR), Psych NP (APN), or similar applicable recognized professional certification based on their state and/or jurisdiction. Providers are responsible for maintaining good standing for their own licenses and medical insurance.
The Providers are independent providers who are neither our employees nor agents nor representatives. The Site’s role is limited to connecting users to Providers on the Site. Providers listed on the Site pay a monthly subscription fee to be listed and use the Site. If you feel the Counselor Services provided by the Provider do not fit your needs or expectations, you may discontinue services with that Provider outside of this Site. Therapeasy, the Site, and its employees may only provide support for website questions and concerns. We are not responsible for patient-provider relationships, including the responsiveness of the Providers. Once you have established the relationship with a Provider, please contact the Provider directly, outside of the Site. Therapeasy waives vicarious liability for the actions of the Providers and the users.
Disclaimers and Limitation of Liability. This Site and its content are offered for informational purposes only; this Site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information. Therapeasy does not specifically endorse any providers listed on this Site.
The Service is not a medical product or medical treatment, and provides no medical services of any kind. You understand and agree that we are not your medical care provider, and that we do not owe you any duty of care regarding your health, safety or wellbeing or any privacy rights in your information.
You should always consult with your own medical professional directly with respect to specific medical conditions or issues. We do not represent or warrant that access to the Site will be error-free or uninterrupted, and we do not guarantee that users will be able to access or use the Site, or its features, at all times. We reserve the right at any time to modify or discontinue, temporarily or permanently, the Site, or any part thereof, with or without notice.
The Site may contain typographical errors or inaccuracies, and may not be complete or current. We reserve the right to correct any such errors, inaccuracies or omissions and to change or update information at any time without prior notice. We may not investigate or perform background searches on users or individuals that appear on the Site. It is up to you to ensure your own safety and suitability in your interactions and meetings with other users of the Site.
Any and all claims relating to your satisfaction, complaints or grievances with any services provided to you by individuals or entities identified or communicated with through the Site shall solely be brought against such individuals or entities, and you agree not to include Therapeasy, the Site or employees in any such claim. HEALTHUP LLC, THERAPEASY, THE SITE, OFFICERS, AND ITS EMPLOYEES SHALL NOT BE HELD RESPONSIBLE FOR LIABILITY THAT RESULTS FROM ANY ACTIONS OR INACTIONS, INCLUDING NEGLIGENCE, OF ANY PROVIDER ON THIS SITE.
You are solely responsible for the content of any posting you make to the Site and any consequences arising from such posting. We assume no responsibility for materials posted by our users or any other actions, conduct or omissions of our users. We do not undertake responsibility for screening or monitoring all our users’ information, communication, or profiles.
If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.
This section (disclaimers and limitation of liability) shall survive the termination or expiration of this Agreement.
Intellectual Property. The Site and its original content, features and functionality are owned by HealthUp LLC, DBA Therapeasy and are protected by U.S. copyright and trademark laws. The graphics, logos, names, design, page headers, page footers, button icons, language, workflow, services and service name are our trademarks, trade names and/or trade dress. You may not use the names of services, trademarks, logos, images or copyrights for any purpose whatsoever other than as permitted by this Agreement.
The software, technology and workflow used by Therapeasy to provide the services to you on this Site is either owned or licensed by us. You are only granted the limited license to such software identified herein, and you shall not be deemed to own or have any title to said software, all of which is expressly retained by us and/or our licensors. At the expiration or termination of this Agreement, you are required to delete and destroy any copies of the software.
The patent for our matching algorithm, time-bound messaging system, machine learning capability and other aspects of our software is pending.
Privacy Policy. Your privacy is extremely important to us. Therapeasy values our user's privacy and we are committed to safeguarding the information you provide us. This document is our Privacy Policy and it contains details on issues related to your privacy when using our Services.
This Privacy Policy applies to our collection and use of information from all users of Therapeasy Services, including, without limitation, visitors using only free Services offered on the website. Please note, this Privacy Policy does not address the privacy practices of third parties, including those with whom we may share information as set forth below.
The Privacy Policy is part of our Terms and Conditions which can be found in our website. The terms in the Privacy Policy (such as, but not limited to, "we", "our", “us", "Site") have the same meaning as in our Terms and Conditions document. This Privacy Policy (“Privacy Policy”) describes the types of information gathered by Therapeasy in the process of providing this website, computing application, services, information, tools, functionality, updates and similar materials (collectively, the “Services”), how we use it, with whom the information may be shared, and our efforts to protect the information you provide to us through the Services. By accessing and using our Site you affirm that you have read the Terms and Conditions and the Privacy Policy and that you understand, agree and acknowledge all the terms contained in both of them.
Information That We Collect We collect the following user information in order to match Users with qualified behavioral health Providers: (such as, but not limited to) user name, contact information including address, insurance carrier, self-identified mental health concerns (such issues with depression or substance abuse), age, and gender.
The Service may permit you to log in through a third-party gateway. If you choose to do so, we may collect additional information about you from those sources.
Protecting this Information is a top priority for us. We will never sell or rent any Information you shared in the Site. Other than in the limited ways detailed in this Privacy Policy, we will never use or disclose any Information unless you specifically and explicitly requested or approved us to do so.
By providing information to Therapeasy, Users consent to our collection of such information and our sharing of that information with a Provider as set forth in this policy. Users and Providers certify that in all cases where personal information is submitted via Therapeasy that the disclosure does not violate the PCI DSS, HIPAA, GDPR, or any other law or regulation.
How We Use Your Information
The Information may be used for the following purposes:- To create your account on our Site and let you log in to your account and use the Site.
- To manage your account, provide you with customer support, and ensure you are receiving quality service.
- To contact you or provide you with information, alerts and suggestions that are related to the Service.
- For billing-related purposes.
- To match you with a Provider.
- To enable and facilitate the Provider services.
- To measure and improve the quality, the effectiveness and the delivery of our Services.
- Market the Site and Provider services to you.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- To comply with applicable state and federal laws, including, but not limited to laws related to protecting client and public health and safety.
- To provide, support, personalize, and develop our Site.
In other words, we accept and gather information in an effort to provide the Services to you. We may also use this information to help us develop and improve our Services, fulfill your requests, send materials to you, inform you about our offers and those of others, tailor our Services to meet your interests, and for other purposes permitted by law.
We use your personal information to administer your account, to send you messages about referrals you have received, to send you information related to referrals you have received, and to send you information about our company and your account.
We use billing and financial information (bank account numbers/credit card numbers) to process recurring membership fees and other fees as applicable, via third-party payment processors. Therapeasy does not store any bank account or credit card information in its own systems. All payment card data and bank account data is stored by our third party vendors who are contractually required to be PCI Compliant and to adhere to all NACHA rules for ACH payment processing.
We may create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.
We may share Information with our business associates, consultants, service providers, advisors and affiliates in order for them to provide services to us, to you, and to enable us to provide the Services. For example, our host and internet service provider may have access to this information. We may share Information with providers on the Service that you interact with or that you select or indicate for information sharing.
How to Manage Your Information
Therapeasy acknowledges the right of individuals to access their personal data. If you are a Provider, you may access and modify your personal and other account information using your account settings page. You may also access, change and modify information previously provided or collected by sending an email to Therapeasy at hello@therapeasy.co to initiate changes or modifications. Note that Therapeasy will require you to verify your identity prior to releasing any personal information.You may close your Therapeasy account by contacting hello@therapeasy.co.
Further, you may request that your personal information be removed from all Therapeasy systems. Note that if you request removal of your personal information you will no longer have access to any existing Therapeasy account and will not be able to use any Therapeasy product or service. Therapeasy reserves the right to retain certain account information for its recordkeeping or compliance purposes.
Opting Out Options
We may offer electronic newsletters and emails concerning current, as well as new products and services, or may provide other marketing materials as a service to our Users and Providers.You can opt out of receiving email marketing by unsubscribing using the unsubscribe link provided in all of our marketing email communications.
Social and Online Tools
We use several publicly available tools, such as (but not limited to) a blog, a Facebook page, a Twitter account, Instagram profile, Google Forms, and others (collectively "Social and General Information Tools"). Any information you provide or share while using Social and General Information Tools may be read, accessed, collected by that site and users of that site according to their Privacy Policy.We may occasionally ask Users or Providers to complete optional online surveys. We may use this data to tailor the experience on the Therapeasy site, provide content that we think might be of interest, and to display content according to a User’s or Provider’s stated preferences.
Phishing
Online identity theft and account hacking, including the practice currently known as "phishing", are of great concern. You should always be diligent when you are being asked for your account information and you must always make sure you do that in our secure system. We will never request your login information or your credit card information in any non-secure or unsolicited communication (email, phone or otherwise).Links

These links are provided for your convenience and to connect you with resources you may find useful. If you click on a third party link, you will be directed to that third website or service. The fact that we link to a website or service is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not have control over third party websites and services and we do not have control over their privacy policies and terms of use. Monthly payments processed for Providers are collected by, maintained by, and processed by our third-party vendor, Stripe (stripe.com). We employ procedural and technical safeguards to secure your personal information against loss, theft, alteration, and unauthorized access, use and disclosure. We also employ security procedures to protect your information from unauthorized access by users inside and outside the company. We apply industry standards and best practices to prevent any unauthorized access, use, and disclosure. We comply with or exceed all applicable federal laws, state laws, and regulations regarding data privacy.Though we make every effort to preserve your privacy, we cannot guarantee your privacy. Regardless of the precautions we take, no transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect personal information, we cannot ensure or warrant the security of any information you transmit to us.
You are responsible for controlling the access to and use of your account, where applicable. Always make sure that your password is kept confidential, and you are logged out of the Site when you are not present or using it. We are not responsible for any unauthorized access to your account or profile, and any ramifications of such access, and is not required to take action to disable any account
Third Party Service Providers
Except as otherwise set forth in this Privacy Policy or in accordance with any request or consent you provide, Therapeasy does not sell, share, or in any other way transmit personal information submitted by Users or Providers to any other persons or companies.We may employ third party companies and individuals to facilitate our Site, to perform certain tasks which are related to the Site, or to provide audit, legal, operational or other services for us. These tasks include, but not limited to, customer service, technical maintenance, monitoring, email management and communication, database management, billing and payment processing, reporting and analytics. We will share with them only the minimum necessary information to perform their task for us and only after entering into appropriate confidentiality agreements.
Children’s Privacy
The Site is not directed and not intended to be used by children under the age of 13 without direction and consent of a guardian. If you're aware that we have collected Personal Information from a child under age 13 without the consent of a guardian, please contact us at hello@therapeasy.co and we will delete that information.All Providers are notified if matched to a User under the age of 18. Each Provider will be responsible to follow all applicable state laws regarding the age of consent of care for minors.
International Transfer
Your information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction. Regardless of where your data is stored, it will be maintained securely as outlined in this Privacy Policy.If you are accessing our Services from outside of the United States, any information provided will be transferred to us or our service providers in the United States. Regardless of where your information is collected or transferred, the information will be treated in accordance with this Privacy Policy.
Compliance with Law Enforcement
We cooperate with government and law enforcement officials to enforce and comply with the law. We may disclose information necessary or appropriate to protect the safety of the public or any person, to respond to claims and legal process (including but not limited to subpoenas), and to prevent or stop activity that may be illegal or dangerous.Changes to This Privacy Policy

You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Site, any part of the Site or the use of the Site, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.
You understand and agree that no Site can be 100% reliable and accessible and Therapeasy cannot guarantee that access to the Site will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.
Refund. HealthUp LLC, DBA Therapeasy, does not offer refunds for our services. Exceptions are considered on a case by case basis by the Company in the delusion of services.
Indemnification. You agree to defend, indemnify and hold us and our suppliers, subsidiaries, licensors, and licensees, and each of their officers, directors, shareholders, members, employees and agents harmless from all allegations, judgments, awards, losses, liabilities, costs and expenses, including but not limited to reasonable attorney’s fees, expert witness fees, and costs of litigation arising out of or based on (a) Submissions or Content you submit, post to or transmit through the Site (b) your use of the Site, (c) your violation of the Agreement, and (d) any conduct, activity or action which is unlawful or illegal under any state, federal or common law, or is violative of the rights of any individual or entity, engaged in, caused by, or facilitated in any way through the use of Site.
Governing Law. This Agreement (and any further rules, policies, or guidelines incorporated by reference), and any claim or dispute arising out of these Terms and Conditions, shall be governed and construed in accordance with the laws of Colorado, United States, without giving effect to any principles of conflicts of law.
Amendment. We may change these Terms and Conditions (the “Agreement”), including the Site Privacy Policy, at any time. The date of the last revision of these Terms and Conditions appear at the end of this page. Your continued use of the Site after the posting on the Site of any changes (whether or not you have also received notice by email) indicates your acceptance of such changes.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
